Terms of Services

The Information Technology Act, 2000 provides legal recognition to electronic records and electronic signatures in India, subject to its requirements and applicable law.

You are responsible for determining whether electronic signatures are appropriate and legally sufficient for your particular transaction, document, jurisdiction, and intended use.

Certain documents, transactions, or jurisdictions may be subject to legal requirements that cannot be satisfied through electronic signatures. Esigns Doc does not guarantee that a particular electronic signature or electronically executed document will be legally enforceable in every jurisdiction or for every purpose.

You retain ownership of documents, information, data, and other content that you upload or submit through the Service (User Content).

You are responsible for ensuring that you have the necessary rights, permissions, and authority to upload, process, send, share, or otherwise use User Content through Esigns Doc.

When sending documents for signature, you are responsible for providing accurate recipient information, assigning appropriate signing roles, configuring signing order and required fields, and ensuring that the document is complete and accurate before sending it.

Recipients are responsible for reviewing documents before signing and determining whether they have the authority to sign them.

Where supported, Esigns Doc may allow senders to create recipient groups in which an authorized member of the group may complete a required signing step.

The sender is responsible for determining which individuals are eligible to participate in a recipient group and ensuring that the configured group accurately reflects the intended signing authority.

Esigns Doc may provide templates that allow users to create reusable document structures and signing workflows.

You are responsible for reviewing templates and ensuring that their contents and configuration are appropriate before using them.

Esigns Doc may provide intelligent or dynamic fields that populate information based on data available within the Service.

You are responsible for reviewing automatically populated information before sending a document for signature.

Esigns Doc may provide cloud-based storage for documents and related records.

Storage availability, limits, retention periods, and other storage-related features may depend on your subscription plan or the configuration of the Service.

You remain responsible for maintaining appropriate copies of important documents and records.

Esigns Doc may maintain records of activity associated with accounts, users, documents, and signing transactions.

These records may include timestamps, user activity, recipient activity, IP addresses, device or browser information, document events, and other transaction-related information.

Esigns Doc uses technical and organizational measures designed to protect the Service and information processed through it.

However, no internet-based service can guarantee absolute security.

You must not upload or transmit content that infringes another person's rights, contains malicious code, violates applicable law, or that you do not have the right to use or distribute.

Certain features of Esigns Doc require a paid subscription or other applicable fees.

You agree to pay the fees associated with the plan or services you select.

Unless otherwise stated, subscription fees are billed according to the billing period selected at purchase.

Subscription prices, document limits, feature availability, storage limits, and other plan conditions will be presented at the time of purchase.

Esigns Doc may offer free trials or promotional access to certain paid features.

Any applicable trial period, eligibility requirements, limitations, and billing conditions will be disclosed when the trial is initiated.

You may cancel your subscription in accordance with the cancellation process provided through the Service.

Cancellation generally prevents future renewal but does not automatically entitle you to a refund for fees already paid, unless required by applicable law or expressly stated otherwise.

Refunds are handled according to the refund policy applicable to the Service and any rights provided to you under applicable law.

Nothing in these Terms limits any non-waivable consumer rights you may have.

Esigns Doc and its underlying software, interfaces, designs, trademarks, documentation, and other platform materials are owned by Esigns Doc or its licensors and are protected by applicable intellectual property laws.

These Terms do not transfer ownership of the Esigns Doc platform or its intellectual property to you.

Esigns Doc may integrate with or rely on third-party services, infrastructure, payment providers, cloud storage providers, authentication services, or other external services.

Your use of third-party services may be subject to their own terms and policies.

Esigns Doc is not responsible for the availability, functionality, security, or practices of third-party services that it does not control.

We aim to keep Esigns Doc available and reliable, but we do not guarantee that the Service will always be uninterrupted, error-free, or available at all times.

The Service may occasionally be unavailable because of maintenance, updates, infrastructure issues, security incidents, third-party services, or circumstances beyond our reasonable control.

You may stop using the Service at any time.

We may terminate or restrict your access in accordance with these Terms.

Upon termination, your right to access and use the Service will end, subject to any applicable post-termination access or data-retention provisions.

You are responsible for exporting or retaining copies of documents and information you need before your account or subscription is terminated, where such export functionality is available.

To the maximum extent permitted by applicable law, Esigns Doc is provided on an "as is" and "as available" basis.

We do not guarantee that the Service will meet every particular business requirement, operate without interruption, or that every document signed through the Service will be legally enforceable in every jurisdiction.

To the maximum extent permitted by applicable law, Esigns Doc and its owners, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, data, or goodwill arising from or related to your use of the Service.

To the maximum extent permitted by applicable law, the total liability of Esigns Doc arising from or relating to the Service or these Terms will be limited to the amount you paid to ESigns Doc for the Service during the applicable period preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
